Q. My car's been written off - how long before I get compensated for the value of my car?
A. This will depend upon how quickly you act. Once you have instructed your solicitor an engineer’s report will be obtained detailing the damage. Assuming this is agreed by you the report will be sent to the Defendant’s insurance company requesting a cheque for the value of your car. If liability is admitted then it would be usual to receive this cheque within 2-3 weeks of sending the report. If liability is disputed then you will not receive any compensation until the Defendant has conceded this or until a court decides the claim in your favour.
Q. Can I make a claim against an uninsured driver?
A. A claim against an uninsured driver will normally be pursued through the Motor Insurers’ Bureau who may compensate victims of uninsured drivers. Your solicitor will be able to advise you further when you speak to them.
Q. I've had an accident with a hit and run driver - what can I do?
A. A claim against an untraced driver will normally be pursued through the Motor Insurers’ Bureau who may compensate victims of untraced drivers. Your solicitor will be able to advise you further when you speak to them.
Q. A road accident has left me unable to work - can I claim for this?
A. As long as liability is admitted for your claim and you are able to produce documentary evidence of your previous earnings and your ongoing loss then there should be no problem in claiming back your loss. The inability to work would need to be supported by medical evidence.
Q. Do I have to go through my insurance company?
A. No. We can arrange an inspection of your vehicle, arrange a hire vehicle for you and arrange repairs to your own vehicle if it is repairable. This way you will not be making a claim on your own policy, your no claims discount will not be affected and there will be no policy excess to pay.
Q. I was a passenger in my partner's car - who do I claim against?
A. Your claim will proceed against whoever was at fault for the accident. If your partner caused the accident then your claim will be against them, via their insurance company.
